Customer Terms & Conditions

By placing an order with tagMODO Web Design Services, you confirm that you are in agreement with and bound by the terms and conditions we have shown below.

Definitions

The Client or The Customer: The company or individual requesting the services of tagMODO Web Design Services.

tagMODO Web Design Services: Primary designer/owner & Employees.

General

tagMODO Web Design Services will carry out the work only where an agreement is provided either by email, telephone or mail. tagMODO Web Design Services will only carry out work for clients who are aged 18 years or above. An “order” is deemed to be a written or verbal contract between tagMODO Web Design Services and the client, this includes telephone and email agreements.

Website Design

We make every endeavor to ensure that the website and any associated scripts and programs are free of errors: tagMODO Web Design Services cannot accept responsibility for any losses incurred due to malfunction, the website or any part of it.

The website, graphics and any code remain the property of tagMODO Web Design Services until all outstanding accounts are paid in full.

tagMODO Web Design Services cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.

Any additions to the brief will be carried out at the discretion of tagMODO Web Design Services and where no charge is made by tagMODO Web Design Services for such additions, tagMODO Web Design Services accept no responsibility to ensure such additions are error free and reserve the right to charge an according amount for any correction to these or further additions.

The client agrees to make available as soon as is reasonably possible to tagMODO Web Design Services all materials required to complete the site to the agreed standard and within the set deadline.

tagMODO Web Design Services will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.

tagMODO Web Design Services will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrongdoing on the part of a site owner.

tagMODO Web Design Services will not be liable for any costs incurred, compensation or loss of earnings due to the work carried out on behalf of the client or any of the clients appointed agents.

tagMODO Web Design Services will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material provided by its agents.

Once a website has been designed and completed, the final payment is then due in accordance with our payment terms. There are no exceptions to this.

Domain Name

The customer maintains full ownership of the domain at all times. tagMODO Web Design Services is only the administrator of the domain name and will never take ownership of the domain name. If there is a dispute between tagMODO Web Design Services and the customer, the customer still maintains full ownership.

If the customer wishes to cancel service with tagMODO Web Design Services, tagMODO Web Design Services is required to release the domain name upon request, but is not responsible for renewing the domain name.

If the customer maintains full control of the domain name, the customer is responsible for any and all changes that need to be made for that domain name. This includes, but is not limited to renewing and changing the name servers for that domain name.

Website Hosting

We host the website on Hostgator. They have great customer and technical support and service guarantee for an annual average of 99% network availability for their infrastructure. Should you require any additional information, please refer to the Hostgator’s own websites for their terms and conditions.

tagMODO Web Design Services is not responsible for any loss due to service outages, but will act in a timely fashion to restore any service outages.

Payment Policy & Billing Procedures

All pricing is guaranteed for the term of pre-payment. tagMODO Web Design Services reserves the right to change prices at any time. For all our website hosting & maintenance customers, ongoing payment is due each anniversary month or period following the date the account was established. If 10 days have passed and payment has not been received, the website will be suspended until further notice (not applicable for Website Design only customers). The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies tagMODO Web Design Services to request termination of services.

Payment of Accounts

It is our policy that any outstanding accounts for work carried out by tagMODO Web Design Services are required to be paid in full, no later than 10 days from the date of the invoice unless by prior arrangement with tagMODO Web Design Services.

Once a deposit is paid and work completed you are obliged to pay the balance of any set-up payment in full. We will contact customers via email and telephone to remind them of such payments if they are not received when due.

Content / Website Copy

The content provided by the customer is owned by the customer.

The material on the customer’s website is provided solely for informational purposes. tagMODO Web Design Services is not responsible or liable to any person or entity whatsoever (including, without limitation, persons who may use or rely on such data/materials or to whom such data/materials may be furnished) for any loss, damage (whether actual, consequential, punitive or otherwise), claim, liability or other cause of any kind or character whatsoever based upon or resulting from any information or opinions provided.

Legal Compliance

You agree to comply with all applicable laws, statutes, regulations and ordinances.

Refund Policy

tagMODO Web Design Services ensures 100% customer satisfaction, our goal is to help small business get online and succeed. Your complete satisfaction is our number one priority!

In case of any dissatisfaction from any of our web design services for your business, you can submit a refund request (either by phone or email) within 48 hours of your website design completion. However, it shall be assumed between both parties that you are satisfied with your website design if a refund request is not received within 48 hours of initial website design delivery.

We also offer a 30 day Money Back Guarantee for all new Customers.

Complaints Procedure

Informal procedure

Anyone who experiences a problem with their web service provided by tagMODO Web Design Services should raise the matter directly using our online contact form to do so, giving sufficient information to locate the material (such as a website URL) and clearly outlining the grounds for complaint.

tagMODO Web Design Services will approach the individual responsible for the material in question with a view to resolving the matter to the satisfaction of the complainant.

Formal complaints procedure

The formal complaints procedure should only be used where the complainant feels that the nature of the complaint is too serious to be dealt with informally, or where a satisfactory conclusion has not been reached after following the informal procedure.

A formal complaint should be made in writing to tagMODO Web Design Services, who will acknowledge receipt and ensure that the matter is looked into as soon as possible.

An initial response to any complaint can be expected within seven days of its receipt; a full and considered response to the complaint should be completed within 30 days and any subsequent remedy implemented with the minimum of delay.

Privacy

Your privacy is very important to us. That is why we will never sell, rent or otherwise distribute the information you provide to us. Your information will only be used for our services.
